Graham Rotary Club
Proceeds will benefit the Graham Rotary Club Foundation’s (“Foundation”) Alamance County Rotary Reads program and other community and international service charities and projects, as further defined by the Foundations annual 2016/2017 budget, (available upon written request). A maximum of 100 tickets will be available for the raffle herein described. The name of prize Winner will be posted on the official raffle website, ________________________________________________________________ on or before April 29th, 2019. This raffle is void where prohibited by law. The source of funds to purchase the prize herein described shall come first; from donation proceeds produced by this raffle, then second; from Foundation general funds. Upon commencement of this Raffle, the Foundation shall maintain a segregated account in the amount of $4,550.00, which shall be used only to fund the event herein described.
NOTICE TO ALL RAFFLE PARTICIPANTS: Raffle ticket has no cash value and is non-transferrable.
2. RAFFLE ELIGIBILITY
The raffle is open to all persons age 18 or older. This includes members of any Rotary Organization including officers and directors of the Graham Rotary Club Foundation, Inc.
3. DETAILS OF RAFFLE ENTRY AND PARTICIPATION
Suggested raffle ticket donation is One Hundred dollars, ($100.00) per ticket. For the purpose of a fair, effective and impartial raffle drawing, the Foundation reserves the right, in its sole and absolute discretion to disqualify on or before the raffle drawing date herein defined any: false entries, entries suspected of being false, illegible entries, defective entries, incomplete entries, physically altered entry forms, and entries that do not include valid or complete payment. All entries become the property of Foundation and will not be returned.
Ticket participant whose ticket number is drawn on April 18th , 2019 will be deemed the Winner of the prize. Winner need not be present to win prize. Winner’s name shall be prominently displayed on a separate webpage and shall be searchable at: __________________________________. Winner will be notified by email, telephone and/or by certified U.S. Mail using the information provided on the Entry Form.
If Winner cannot be located or fails to respond within ninety (90) days after the Foundations first attempt, (by utilizing each contact method herein defined), then Winner will be deemed to have forfeited their prize.
Another raffle ticket will not be drawn nor will there be a “back-up” Winner. The prize shall be deemed forfeited if the Winner cannot be reached or cannot accept or receive the prize for any reason within the time allowance specified herein. Winner grants permission for the use of their names, photographs/likenesses for advertising and promotion for this and similar promotions without compensation, unless prohibited by law.
5. RULES AND LIABILITIES
Operation of the raffle shall be conducted by the Foundation and managed by its all-volunteer Board of Directors. The raffle is subject to these Official Rules.
These Official Rules shall not be changed by any oral statement made by any person acting on behalf of the Foundation. By participating, ticket recipients who donated to the Foundation agree to the following:
1. To be bound by these complete raffle rules and the decisions of Foundation shall be final and binding.
2. To waive any right to claim ambiguity in the Raffle or these Official Rules, except where prohibited by law.
3. By accepting a prize, the Winner agrees to release Foundation, officers, board members, members, representatives and agents, and any person or entity associated with the production, judging, or administration of the raffle from and against any claims, damages, disability, attorneys’ fees, and costs of litigation and settlement, as well as any liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from redemption, acceptance, possession, ownership, misuse or use of any prize or participation in any raffle-related activity or participation in this raffle.
4. Except where prohibited by law, the Winner’s amount for a raffle ticket and acceptance of a prize constitutes permission for Foundation to use the Winners name, photograph, likeness, statements, biographical information, voice, and city and state address for promotional or advertising purposes in connection with this Raffle on a worldwide basis, and in all forms of media, now or hereafter known, in perpetuity, without review, permission or further compensation.
5. These Official Rules and posting of Winner on Foundation website shall remain active and available for access until December 15, 2019.
Taxes, if any, are the sole responsibility of the Winner. Selected Winner will receive an IRS Form W2G and the amount of the winnings (at the Estimated Fair market Value of $4,500.00) will be reported to the IRS upon complete certified U.S. Mail or Express delivery of prize herein defined for tax year 2019. Foundation shall deliver IRS form W2G to Winner no later than January 31, 2020. Each ticket purchaser is advised to consult his or her own tax advisor(s) with respect to the tax liabilities that may arise from winning the prize in this raffle.
Personal information collected during a donation for ticket(s) will only be used to contact the Winner of the raffle and internally for future raffles. No information will be sold or shared with any third-party websites or companies.
8. GENERAL RAFFLE INFORMATION
Foundation reserves the right to disqualify any entrant it finds to be tampering with the entry process or the operation of the raffle or violating these Official Rules. Disputes regarding these Official Rules and/or this raffle will be governed by the laws of the State of North Carolina.
Any claim(s) or controversy between any of the raffle participants and Foundation arising out of or relating to the raffle and or the raffle rules and regulations will be settled by binding arbitration administered in Alamance County, North Carolina by the American Arbitration Association under its Commercial Arbitration Rules. Any Judgment on the award rendered by the arbitrator maybe entered in any court having jurisdiction thereof. Caution should be taken for any attempt to deliberately damage or to undermine the legitimate operation of the Raffle.
Any such attempts may be in violation of criminal and civil laws and will result in disqualification from participation in the Raffle. Should any attempt be made, Foundation reserves the right to seek remedies and damages, including all fees, such as attorney fees and court costs, to the fullest extent of the law, including criminal prosecution.
A raffle Winner’s sole and exclusive remedy for any claim against Foundation arising out of the distribution of raffle tickets or the conduct of the raffle will be limited to the return of the amount of the raffle ticket(s). In no event will Foundation, its directors, officers, agents or representatives be liable to any party for any loss or injury to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.
Winner of prize is required to make arrangements to schedule the vacation with Graham Travel at 336-222-1000 215 N Main Street, Graham, NC 27253 at to redeem the Prize. Reservations must be made and prize redeemed between May 29th, 2019 and December 15, 2019.
In the event that the prize is not redeemed by December 15, 2019 it shall become null and void.
